תיקון זה מדגיש את הצורך בשיח בתום לב על החלקים בהמצאה במקרה של שימוש משולב בתשתיות,
כפי שאני צופה שיהיה במינוי של ד"ר כספי
מינוי זה שונה מזה של חוקר שמגיע לתקופה מסויימת ב100% מזמנו באת"א.
מכיוון ששינוי זה אינו משנה את נוסחת הבסיס שלכם, אני מקווה שזהו הסבב האחרון של ההסכם.

מצ"ב הסכם מתוקן עם אוניברסיטת ת"א בנוגע למינויו של אלעד כספי לחוקר אורח
על אף מינוי זה, אלעד הינו מועסק במשרה מלאה על ידי קמ"ג.
להבנתי התיקון שעו"ד דניאל לייט (מכותב) הוסיף להסכם הקודם מבהיר אם קניין רוחני הנוצר מעבודה שאינה 100% בת"א,
הרי שלגביו שני המוסדות יתקיים מו"מ הגון על חלקו של כל מוסד בקניין

נא ראה מצ"ב מייל ששלחתי לפני כשבוע אשר מתייחס להערה של קמ"ג (כולל טיוטה מתוקנת והסברים מצידנו). בקשר למצב שהמצאה תיווצר אך ורק באת"א, נבקש להחיל את הנוסח שאת"א משתמת בו עם שאר מוסדות בארץ (גם כאורח וגם כמארח) וכפי ההסבר שלי במייל המצ"ב.

שמי איל יהל ואני המדען הראשי של הקריה למחקר גרעיני - נגב.
פנה אלי ד"ר אלעד כספי לאחר שקיבל פנייה מאנשי האוניברסיטה למנותו לחוקר אורח (visiting researcher).
במסגרת זו, ד"ר כספי נדרש לחתום על מסמך המיועד להסדיר את נושא הקניין הרוחני.
טיוטת המסמך הועברה לעיוני (מצ"ב), אולם איני יכול לאשר את חתימה על מסמך זה.
הקמ"ג חותמת על הסכמי מחקר ומינויים מול מוסדות מחקר שונים בארץ ובחו"ל.
הסכמים אלו מבוססים בדרך כלל על עקרון של 'תרומה המצאתית'.
טיוטת המסמך שהועבר, אינה מאמצת עיקרון מקובל זה, אלא מקבעת מראש את אופן חלוקת הזכויות העתידיות.
אופן זה אינו מקובל עלינו כארגון, בפרט במקרים בהם מדובר בעובד מדינה המועסק במשרה מלאה בקמ"ג.
למעשה, רק חלק קטן מזמנו של ד"ר כספי צפוי להיות מוקדש למחקר המשותף עם חוקרי את"א.
לצד זאת ולטובת קידום פתרון לנושא, העברתי לד"ר כספי נוסח שנחתם מול MIT בעניין דומה, ואשר יכול להוות דוגמא עבורך.
