In accordance with your instructions we have prepared and electronically-filed the above-identified Provisional Patent Application in the US Patent and Trademark Office (USPTO). 

 

This Application received the filing date of 24 February 2021 and Serial No. 63/152,860.

 

Please read the attached definition of a US Provisional Application.

 

If you intend to convert the Provisional Application into a US Utility Patent Application, or to file corresponding applications in other countries under the International Convention, and claim priority from the above-identified Patent Application, this should be done prior to the expiration of 12 months from the above filing date, namely prior to 24 February 2022. Please let us have your instructions well before the due date.

 

So as to obtain an early priority date, this Application was filed without an executed Assignment form. Please find attached an Assignment form to be signed and dated by the inventors. If you are interested in filing a request for recordal of assignment for this Application to Technion Research & Development Foundation Limited and Nuclear Research Center - Negev, please send us the executed form by email or fax to 073-7919100. Upon receipt we shall file the request for recordal of Assignment. Note that until such time the Application will remain in the name of the inventors.

 

Enclosed is a copy of the Application as filed for your records, together with a copy of the Electronic Acknowledgement Receipt issued by the USPTO. The Filing Receipt will be forwarded to you as soon as received (usually within 5-6 months from the filing date).

 

Important note:

Article 4 of the Paris Convention stipulates that any person who files a patent application in one of the union countries, or his successor in title, shall enjoy, for the purpose of filing in the other countries, a right of priority. In view of recent verdicts in various jurisdictions, for subsequent applications filed by an entity other than the person/entity who filed the priority application, a valid transfer of the priority application right, including the right to claim its priority, must take place prior to filing the subsequent application(s). In other words, the Applicant of the subsequent application must own the whole of the priority application, including the right to claim its priority, at the time of filing the subsequent application(s).

 

Accordingly, with respect to the above identified application, we strongly recommend executing an Assignment of rights from the inventors (Assignors) to the Applicant (Assignee) prior to the filing of an International patent application (PCT) and/or continuation applications in other jurisdictions. Such an Assignment should explicitly specify the right to claim priority and should be signed by the Assignors. An Assignment with an execution date after the filing of an International patent application (PCT), and/or continuation applications in other jurisdictions, may result in the loss of the priority claim and other possible unintended consequences.

 

PATENT TERM EXTENSION

 

Extensions for protection of up to five years may be available in various jurisdictions for patents claiming inventions in certain fields requiring marketing approval and/or subject to regulation, such as but not limited to, medical (e.g., drugs and medical devices), food, feed and agro (e.g., agrochemicals and plants) products that require and/or have received regulatory marketing approval, under certain circumstances. Extending the duration of a patent requires filing an application to this effect with the patent office in each jurisdiction in which patent term extension is available and desired, within a specified time period from the date of issuance of the marketing approval in that jurisdiction, depending on the jurisdiction, typically within a few weeks.

 

Therefore, please advise us of any developments towards marketing approval of the product subject of the patent(s) to be extended. Should you require additional information regarding this issue, we remain at your service.

Please find attached a disclosure form for a new semi-drafted US provisional patent application. Prof. Behar is copied on this email and we ask him to urgently provide you with a Word copy of the draft publication paper for use in the patent drafting. 

The applicants are Technion Research & Development Foundation Ltd. and Nuclear Research  Center Negev. Please split debit notes 66.7% TRDF and 33.3% NRCN. Please use the TRDF address for its inventors, Dr. Yehel from NRCN is also copied on this email to provide its inventors addresses as required.

We understand that that a presentation  is planned for mid-December and we ask Prof. Behar to confirm the exact date.

Please confirm that you can handle this matter and update us if semi-drafting will not be possible in the time limit. Please also send us a cost estimate.
