I wanted to update you that we heard from Nir Velozny that after the court decided on the return of the children to Israel the mother filed an appeal. The appeal is still being heard, but the court denied her stay motion (attached).
As per the instructions of the court, the mother submitted her flight plans (attached).
We will keep you posted as to the actual return taking place.

Sorry, I wrote "Israel" instead of United States. I meant to ask whether under US law the child can leave the United States on an Israeli passport, or whether he must leave the US on an American passport – could he be prevented from leaving the US if he doesn't have an American passport.

Hi Leslie,
I haven't heard anything further from Mr. Velozny's U.S. attorney, but I will follow up. Regarding the passport, I know that individuals with Israeli citizenship, regardless of other nationality, including U.S. citizenship, must enter and depart Israel using their Israeli passports. The child could leave Israel and travel back to the U.S. with either a valid visa or they could apply for a new U.S. passport at the Embassy.

Dear Kristen,
Mr. Velozny's attorney in Israel has just contacted us as well concerning the passport of the older son.
In your e-mail last week you stated that if the mother was going to appeal the judgment, she would have to apply to stay the execution of the judgment and if so, it was expected that she would do so any day. Are you able to update us as to whether she has done so? If she hasn't and the judgment is executable now, we will inquire as to how quickly an Israeli passport could be obtained. Normally they can be obtained quickly, so as to meet the goals of the Convention. Would the child be able to leave Israel on an Israeli passport, or must he have a valid American passport?

I hope you are well. I'm not sure if Mr. Velozny has reached out to you yet, but it appears that his oldest son's passports are expired and he will need a new one issued in order to return. I'm not sure whether there is a preference to obtain an Israeli vs. U.S. passport in this situation, but I do know that there has been a long waiting period to obtain U.S. passports here.
I can speak with my colleagues in Prevention to see if there's anything that can be done to expedite the process if he chooses to apply for a U.S. passport, but I wanted to know whether it might be quicker to apply for a new Israeli passport.

We are reaching out because there is something that perhaps you or the Israeli state department can help us with. Mr. Velozny’s oldest son’s, Ron, two passports (US and Israel) are expired. Please see his email below and the attachments here. His wife is not cooperating in having new passports issued, and in any event, we understand that it is taking many months to renew US passports. The concern is that she will use the expired passports as an excuse to avoid repatriating the children. Is this something you/your department can help with, or is there someone in the Israeli state department who can help Mr. Velozny? Thank you.
